These General Terms and Conditions (GTC) apply to all orders placed through the online shop tomazonas.at between Mag. Tanja Jakob-Tomazi, TOMAZONAS \u2013 Dietary Supplements (Sole Proprietorship), Pudexing 33, 5273 St. Veit im Innkreis, Austria, E-mail: tomazonas@gmx.at, Phone: +43 660 7739 288 (“we”), and its customers (“you”). The version valid at the time of the order shall be decisive. If the customer is a consumer within the meaning of the Consumer Protection Act (KSchG), its mandatory provisions shall take precedence over these GTC. <\/p>\n
The presentation of products in the online shop does not constitute a binding offer, but an invitation to place an order. By clicking the order button, you submit a binding offer to purchase the goods in the shopping cart. Before submitting the order, you can review and correct your details at any time. Immediately after placing the order, you will receive an automatic confirmation of receipt of your order; this does not yet constitute acceptance. The contract is concluded when we accept the order by means of an order confirmation via email or by dispatching the goods. The contract text will be stored by us and sent to you with the order confirmation. The contract language is German. <\/p>\n
All prices are in Euro. As a small business owner in accordance with \u00a7 6 para. 1 no. 27 UStG, we do not show VAT; the stated prices are final prices. In addition, shipping costs, which depend on the country of delivery and the scope of the order, will be displayed during the ordering process. For deliveries to countries outside the European Union, import duties, customs fees, and charges may apply, which are to be borne by you. <\/p>\n
Payment can be made either via PayPal or cash on delivery, provided these payment methods are offered during the ordering process. For PayPal payments, your account will be debited upon completion of the order. For cash on delivery, the invoice amount is to be paid to the shipping company upon delivery of the goods; additional fees from the shipping company may apply, which will be shown during the ordering process. <\/p>\n
We deliver to the countries specified in the ordering process. Unless otherwise stated for the product, the delivery time is usually 3 to 7 working days within Austria and correspondingly longer for international deliveries. If an ordered product is not available, we will inform you immediately; payments already made will be refunded without delay. For consumers, the risk only transfers upon delivery of the goods to you or to a third party designated by you. <\/p>\n
The delivered goods remain our property until full payment.<\/p>\n
Consumers have a statutory right of withdrawal of 14 days. Details, including exceptions and the sample withdrawal form, can be found in our Information on the Right of Withdrawal<\/a>. <\/p>\n The statutory warranty provisions apply, for consumers in particular the Consumer Warranty Act (VGG). Please notify us of obvious transport damage or defects as soon as possible; your statutory rights remain unaffected. <\/p>\n We are liable according to statutory provisions for intent and gross negligence. For slight negligence, we are only liable for the breach of essential contractual obligations. These limitations do not apply to personal injury or claims under the Product Liability Act. <\/p>\n Our products are dietary supplements. They are not a substitute for a balanced and varied diet and a healthy lifestyle. The stated recommended daily intake must not be exceeded. Keep out of reach of small children.
